Clark County Constable Glenn Witt made his first appearance in federal court Wednesday, after being indicted by a federal grand jury for allegedly selling oxycodone pills.

Witt, 52 of 4013 Paris Road, was arrested in July by Clark County Sheriff deputies after receiving information he was selling pills.

Witt has already been indicted by a Clark County grand jury for first-degree trafficking in a controlled substance but was indicted by a federal grand jury Dec. 1, according to court records.

The federal indictment warrant was executed Wednesday morning, prior to Witt’s appearance in U.S. District Court in Lexington.

Witt pleaded not guilty to two counts of distribution of a controlled substance and a trial was set for Jan. 17 in Lexington.

Upon conviction, he could receive a maximum of 20 years in prison, a $1 million fine and three years of supervised release.

The indictment alleges Witt sold the pills on July 11 and 13. Witt was arrested by deputies July 13 after he allegedly sold pills to a confidential informant. During the arrest, deputies recovered the marked buy money, his badge and his firearm.

Clark County Sheriff Berl Perdue said previously rumors of Witt selling pills had circulated for several months. When the rumors intensified this summer, deputies opened an investigation, he said.

Witt had been released on bond and his case was pending in Clark Circuit Court.

In Kentucky, constables have full police powers but are not required to be trained. Witt was first elected in 2007. Clark County does not allow constables to have blue lights or other emergency equipment on their vehicles.
