Winchester man sentenced to two years for pursuit

A Winchester man charged with fleeing from the police in a stolen car decided to go ahead and plead guilty during his first appearance in Clark Circuit Court.

Daniel V. Banks, 33, was indicted in February for first- and second-degree fleeing or evading police, first-degree wanton endangerment, receiving stolen property and being a persistent felony offender for an incident on Jan. 6.

Thursday, prosecutors agreed to dismiss the PFO charge and Banks pleaded guilty to the rest for a total sentence of two years and a day. Banks said he was already serving another state sentence and requested to be sentenced as well, which the court obliged, adding it will run consecutively to his other case.

The incident happened on the afternoon of Jan. 6 when Winchester Police were notified to look for a stolen Ford Expedition near Clark Regional Medical Center. When an officer attempted to stop the vehicle, it sped up.

“I got scared and took off,” Banks told Clark Circuit Judge Jean Chenault Logue Thursday morning. “Apparently the vehicle was reported stolen.”

Police said they pursued the vehicle down Bypass Road. Other officers set up spike strips at the intersection with Boone Avenue, which damaged the vehicle before it turned onto Boonesboro Road and then Old Boonesboro Road. The vehicle stopped at 5925 Old Boonesboro Road, and Banks ran inside, where officers found him in a kitchen cabinet.

Following his arrest, he was served a warrant for a parole violation for a burglary conviction from Montgomery County and one for non-payment of fines from Madison County.
