A woman claiming she was assaulted and robbed last year testified Wednesday she had sex with Darvin Johnson to protect her son.

Darvin Johnson, 35 of Akron, Ohio, was arrested in March on a warrant charging him with kidnapping, first-degree robbery and first-degree rape for incidents on

Sept. 21, 2016.

Wednesday in Clark District Court, the alleged victim said she had a sexual relationship with Johnson. She said he had been in her home that morning and asked for sex, but she said no. He returned a second time unannounced and said he needed $100 to get to Ohio. She said Johnson planned to take her sister’s car and destroy it there. She said she also refused to give him a ride to Ohio.

When Johnson showed up the second time, she said he was angry. He got a knife from her kitchen and told them to sit on the couch and “not do anything stupid.”

At one point, she said Johnson grabbed her son by the throat and threatened to break his neck and slammed her head against the wall.

She said Johnson made her put her son in the back seat of her car and he drove them both to Central Bank, where she withdrew $100 from the ATM. Johnson had the knife at that point, she said.

“I didn’t really know (what would happen),” she said. “All I was worried about was my son’s safety.”

When they returned to her apartment, she said she put the child in his room and they had sex.

“I wasn’t going to put my baby in any more trauma,” she said. “Whatever (Johnson) wanted, he could have. I didn’t know what was going to happen to us.”

Afterward, she said Johnson cleaned up and left.

The woman said her mother took her to the Winchester Police Department following the incident. She also said she called 911 twice earlier in the day, but got no response. 

Detectives obtained a warrant for Johnson’s arrest on Sept. 28, 2016.

Following the hearing, Clark District Judge Brandy Oliver Brown found enough probable cause to send all three charges to the grand jury for further action.

Johnson remains in the Clark County Detention Center on a $50,000 cash bond.
