A former pageant queen and her husband are now facing robbery charges over an incident involving a pair of shoes.

Toniya Coles and her husband Carl Coles were arrested June 27 for first-degree burglary after they allegedly entered a residence to reclaim a pair of stolen shoes. According to court records, Carl Coles had a handgun at the time of the incident.

Wednesday afternoon, prosecutors amended the charges against the Coles to first-degree robbery, after the homeowner was expected to testify in a preliminary hearing the Coles had permission to be in the home. Clark County Attorney Brian Thomas said burglary requires the defendant to be enter or remain unlawfully, while robbery does not.

“The allegations deal with a firearm being brought into a residence and threats being made,” Thomas said. “If I have a gun and take something from you, that’s robbery.”

After the charges were amended, the Coles’ attorney waived the case to the Clark County grand jury for further deliberation.

The Coleses, of 4 Hart Ave., were arrested June 27 outside the residence where the incident allegedly took place. Witnesses told police the couple entered the residence and demanded that a pair of shoes be returned to them. The shoes were handed over and the couple left.

While officers were on the scene taking the report, the Coleses drove up and stopped outside. They were identified by those in the house and were arrested.

On social media after her release from jail, Toniya Coles said the shoes were stolen from her son and admitted to going to the home on Carolina Avenue to get them back.

First-degree burglary and first-degree robbery are both class B felony charges with a sentence of 10 to 20 years upon conviction.

Toniya Coles was crowned Miss Kentucky Plus America in 2013 and competed at the national pageant.
