Robbery waived to grand jury

An 18-year-old facing felony robbery and assault charges decided to send the case to the grand jury.

Brandon Hart, 18, of 414 E. Broadway St., was charged along with two juveniles for the Aug. 30 incident.

According to Winchester Police, the victim, 19-year-old Logan Ramsey, was shot twice after an alleged drug deal for marijuana didn’t go as planned.

Wednesday in Clark District Court, Hart and his attorney decided to waive the case to the grand jury, rather than have a preliminary hearing to establish probable cause.

Two juveniles, a 16-year-old female and a 17-year-old male, were also arrested for first-degree robbery and first-degree assault. They are being prosecuted in juvenile court, where proceedings and the records are confidential and sealed.

Ramsey told police one of the juveniles scheduled the meet for a purchase of marijuana. Ramsey said one of the juveniles demanded money while Hart and the other pulled guns. Ramsey said he ran, but was shot in the shoulder and back before being kicked. Ramsey said they also took his cell phone and money.

Winchester Police Capt. James Hall said previously that Hart claimed Ramsey took the marijuana and ran. Hart said he and one of the juveniles chased Ramsey until he fell. The juvenile hit Ramsey and took the marijuana, but Hart told police he did not see anyone fire any shots.

Hall said officers recovered two handguns and marijuana were recovered from Hart’s residence.
