Woman sends sexual abuse case to grand jury

A Clark County woman charged with sexual abuse of a female juvenile waived her case to the next level Wednesday afternoon.

Penny Simmons, 60, of 4519 Paris Road, was arrested earlier this month for first-degree sexual abuse and endangering the welfare of a minor for allegedly using the 13-year-old girl to spank 61-year-old James Simmons’ buttocks for his sexual gratification, according to court documents.

Wednesday in Clark District Court, Penny Simmons pleaded guilty to endangering the welfare of a minor and was sentenced to 90 days. Her sexual abuse charge was sent to the grand jury for further action.

Penny Simmons told detectives with the Clark County Sheriff’s Office she also saw James Simmons in the child’s bedroom watching “pornographic videos” with his hand under the covers while the child slept.

James Simmons was arrested in December for two counts of first-degree sexual abuse for the same incident. He is waiting for the grand jury to act in his case.
