Rape case headed to grand jury

A George Rogers Clark High School student charged with felony second-degree rape will wait for the grand jury to act after waiving a probable cause hearing Wednesday.

Andre McKyle Delgado, 18, of 253 Cook Ave., was arrested March 16 after allegedly having intercourse with a 13-year-old girl six days earlier.

The victim’s mother said her daughter was spending the night with another girl, and they snuck out of the house to go to a party with another teenage boy.

The boy reportedly drove them to Delgado’s home and gave the girls alcohol, the mother said.

The Sun is not releasing the mother’s name to protect the victim’s identity.

According to court documents, Delgado told police the girls had been drinking when they arrived at his house with the other boy. One of the girls, he said, started “grinding” on him and wanted intercourse.

Delgado told police the victim told him she was almost 16, when in fact she was 13.

Delgado admitted he had intercourse with the girl, though.

If indicted and convicted, Delgado could face a sentence of five to 10 years in prison.
