The third suspect from a January drive-by shooting made his first court appearance after being returned to Clark County.

Jacob Hornback, 21, of 1102 Westwood Drive, had been jailed in Fayette County on unrelated charges since the Jan. 8 incident near Arlington Road and West Lexington Avenue.

Wednesday in Clark District Court, the judge entered an automatic not-guilty plea and scheduled a preliminary hearing for March 13.

Hornback is charged with complicity to commit first-degree assault.

According to Winchester Police, Hornback, along with co-defendants Chase Winings and Heather Cunningham, were driving around Winchester on Jan. 8 looking for Dalton Rogers, who they claim robbed Hornback and Cunningham at their residence around 12:30 a.m.

Police said the group found Rogers sitting in his parked car, pulled alongside it and Winings opened fire.

Rogers was able to drive himself to the Winchester Police Department and identified Hornback, also known as Chucky Sanchez, as the one who shot him.

He was then transported by ambulance to the University of Kentucky Medical Center.

Police then interviewed Hornback and Cunningham who initially denied that Winings was in the car at the time, but Winings later admitted to firing the shots.

Winings and Cunningham are waiting for the grand jury to act on their cases as well.
