Officer assault case sent to grand jury

A man charged with assaulting a Winchester Police officer while handcuffed sent his case to the grand jury.

Donnie Marvin Brown, 31, of 27 E. Washington St., is facing a dozen charges including drug possession, theft and escape from the July 24 incident.

According to court documents, the incident started after Brown allegedly used two counterfeit $50 bills to purchase a cell phone. The victim notified the Winchester Police, who accompanied her to Brown’s residence. Brown allegedly gave police his brother’s name and personal information, but fled when a detective identified him.

Brown was captured after a brief foot pursuit and taken to the Clark County Detention Center.

Winchester Police Patrolman Kelly Webster was leading Brown into the jail when he allegedly began to run again. Officers said Webster used her Taser before Brown tried to disarm her.

When other officers arrived, Webster and Brown were fighting with each other in front of the jail, during which Brown hit her in the face with one of the handcuffs.

Brown was brought under control and booked into the jail.

Officers recovered a counterfeit $100 bill, the cell phone and suspected illegal drugs during the arrest.

Brown was charged with first-degree possession of a controlled substance, first-degree fleeing or evading police, first-degree criminal possession of a forged instrument, theft by deception, theft of an identity (two counts), resisting arrest (two counts), first-degree assault on a police officer, second-degree escape, third-degree criminal mischief, second-degree possession of a controlled substance and third-degree possession of a controlled substance.
