Two people who allegedly organized the shooting of another person in January will serve five years in prison for their roles.

Jacob Hornback and Heather Cunningham were sentenced Thursday in Clark Circuit Court. Both pleaded guilty in September to assault under extreme emotional disturbance for the January shooting of Dalton Rogers

The person who shot Rogers, Chase Winings, was in custody in Fayette County and was not in court Thursday. His sentencing was rescheduled for February 2020.

In her guilty plea, Cunningham said Rogers entered her apartment that night and put a gun to her child’s head.

After Rogers left, Hornback said he called Winings and asked him to come to Winchester from Lexington.

The three then drove around town until they found Rogers sitting in his car near Arlington Road and Lexington Avenue.

Winings said he did not know if he actually shot someone initially.

“I let my emotions take over,” Winings told Clark Circuit Judge Jean Chenault Logue in September. “I rolled the window down … and opened fire.”

After the shooting, Rogers drove himself to the Winchester Police Department. He was then transported to the University of Kentucky Medical Center with multiple injuries including two collapsed lungs and a lacerated liver.

Prosecutors said previously Rogers has been uncooperative and they have not been able to contact him.
