A man has been arrested on an assault charge after an alleged incident at the BP station on Fulton Road, according to the Winchester Police Department (WPD).

Around 6 p.m. last Saturday, a WPD officer was dispatched in response to a disturbance at the gas station.

Upon arrival, the officer stated that they encountered a man, later identified as 55-year-old Phillip Gunter, nude from the waist up and swinging a shirt in the face of another male who was on the phone, according to the arrest citation.

The male on the phone told police that Gunter had allegedly hit him in the face with a closed fist and had no idea why.

Gunter told the officer that he never hit the other party and just swung his shirt in the man’s face.

According to the arrest citation, the officer stated that Gunter smelled of alcohol and had extremely slurred speech. Gunter allegedly told the officer he “had a few beers.”

While the investigation was ongoing at the scene, a woman drove into the parking lot and Gunter claimed she was his ex-girlfriend there to give him a ride.

The woman confirmed that Gunter called her to pick him up. According to the arrest citation, it was later determined that the woman had an active domestic violence order against Gunter.

Gunter was arrested and charged with 4th-degree assault, alcohol intoxication in a public place and violation of a Kentucky EPO/DVO.

He is currently lodged at the Clark County Detention Center on a $2,500 cash bond and is scheduled to appear in court on July 10.
