The case involving the alleged kidnapping of a store manager during a robbery will go before a Clark County jury this fall.

Thursday, a judge set a Nov. 6 trial date for James Mahan and Charlotte Smith, both of Powell County. The trial comes almost a year to the day they allegedly stole from the Dollar General in Winchester and took the store manager hostage as they fled.

According to court documents, Mahan and Smith were allegedly stealing items from the store on West Lexington Avenue on Nov. 3, 2016. When they were confronted by a store employee outside the store, Mahan allegedly began hitting the man, while Smith got in the car. Mahan brought the other person into the car and Smith began to drive away.

The employee told police Smith said they would take him to her brother’s house and kill him. The victim escaped by jumping from the car when it slowed on Lexington Avenue. The car continued on.

Mahan and Smith were arrested Nov. 30, 2016 by deputies from the Powell County Sheriff’s Office.

Both Mahan and Smith are in jail awaiting their trial.
